A decision framework for West Maui condo owners weighing whether to sell, hold, shift use or follow the evolving H-3/H-4 zoning process before the 2029 phase-out date.
This is not investment, tax, or legal advice. There is no single answer to whether you should sell a Bill 9-affected West Maui condo before 2029. The useful work is a decision framework for your building, your goals, and the facts that can actually be verified.
The decision usually turns on the specific property, current zoning, remaining rental economics, HOA and insurance costs, market value, tax situation, and where that building sits in the H-3/H-4 referral process. Two owners in the same complex can reasonably choose different paths.
What the 2029 Deadline Means for West Maui Owners
Under Ordinance 5909 (Bill 9), transient vacation rental uses in apartment districts in the West Maui community plan area may continue through December 31, 2028 and must cease January 1, 2029 unless otherwise exempt or permitted. The deadline is a planning date, not a prediction of your sale price. What changes for many owners is the use case a future buyer can underwrite, which can change who shows up and how long a listing sits.

What the 2026 Maui Condo Market Is Telling Sellers
REALTORS Association of Maui figures for July 2026, reported by Maui Now on August 12, showed 82 closed condominium sales countywide, up 54.7% from July 2025. The median condo sale price was $690,000, up 2.2%. Condos spent 153 days on market, up 5.5% from a year earlier.
The takeaway is not that the market is booming, and it is not that buyers disappeared. Transactions are occurring. Buyers still have choice and time. Countywide medians also are not West Maui building comps. Price to the unit in front of you.

How Bill 9 Can Affect Buyer Psychology
Some buyers will only look at hotel-zoned or clearly residential product. Others will still buy apartment-district TVR inventory if the price, remaining use period, and documents are clean. The friction is often slower decisions, more conditions, and a smaller pool, not a frozen market. How you present the file matters as much as the headline law.
Documentation Matters More in an Uncertain Market
Buyers who stay in the deal are usually the ones who can answer hard questions quickly. Have AOAO documents, insurance context, reserve and assessment history, rental records where you are representing income, renovation receipts, and zoning printouts in one place. That is building intelligence, not a slogan. The owner resale checklist is a practical place to start.

- What is the current zoning and TVR posture for this TMK?
- What will my net proceeds look like after costs, and what is my tax picture with a CPA?
- If I hold, what is the monthly carry with conservative income assumptions?
- If I sell, is the unit actually ready to compete on photos, repairs, and disclosures?
- If I am waiting on H-3/H-4, what is my backup plan if the map never changes?
