Hotel zoning generally refers to land-use districts intended to accommodate hotel or transient-accommodation uses. However, zoning by itself does not prove that every condominium or every unit can legally be operated as a short-term rental.
Before relying on rental income, buyers should verify the parcel, the individual unit, current county requirements and the condominium association’s governing documents.
Rental eligibility is property-specific. Building names, listing remarks, tax classifications and past rental activity should not be treated as substitutes for written zoning and AOAO verification.

The rental potential of a West Maui condo cannot be evaluated from a listing description alone. A complete review should address legal use, association rules, operating expenses, building risk and nearby alternatives.
Review county zoning, parcel information, the individual unit and any written documentation supporting transient use. Prior rental activity does not by itself establish future eligibility.
County zoning does not override association restrictions. Review declarations, bylaws, house rules, rental minimums, management requirements and pending association votes.
Model occupancy and nightly rates conservatively. Then subtract management, housekeeping, taxes, platform fees, utilities, repairs, maintenance, insurance, AOAO fees and vacancy.
Examine insurance renewals, reserve funding, upcoming capital projects, special assessments, litigation and factors that may affect financing or resale.
Do not evaluate a unit only against other listings in the same building. Compare its complete carrying cost, rental flexibility, condition and buyer appeal with nearby resort communities.
Bill 9 changed the regulatory context for transient vacation rentals operating in apartment districts. It did not make every hotel-zoned condominium automatically eligible for short-term rental use. Property-specific zoning, unit status and association restrictions still need to be verified.
