Papakea Resort in 2026: Bill 88 Status, Rental Rules & Buyer Due Diligence

A 2026 buyer-focused look at Papakea Resort's Bill 88/H-3/H-4 context, rental considerations, building due diligence and what buyers should verify before purchasing.

Papakea remains one of West Maui’s better-known resort condominium properties, but buyers evaluating a unit in 2026 need to understand more than the view, asking price, and rental history. Current county zoning legislation makes the property’s regulatory context part of the due-diligence process.

This article is not a second amenities guide. Location, layouts, and day-to-day building description belong on the evergreen Papakea condo guide. What follows is 2026 legislative context, Bill 9 versus Bill 88, and the questions that should sit next to any offer.

Papakea's 2026 Zoning Context

Papakea (3543 Lower Honoapiilani Road, Honokowai) was named in Resolution 26-111, which the Maui County Council adopted in late July 2026 and referred to the Maui Planning Commission. Maui Now reported that 26-111 covers properties the county describes as already operating like hotels. A public notice published in August 2026 listed Papakea among properties proposed for community-plan and zoning-district changes, including a proposed shift of a portion of the property from A-2 Apartment to H-4 Hotel.

As of August 31, 2026, that is still a proposed, referred process. Do not call Papakea “H-3/H-4 zoned” unless a final adopted change in zoning for the relevant TMK actually supports that statement. Planning Commission hearings were noticed; a noticed hearing is not an approval.

On August 27, 2026, the Council’s Housing and Land Use Committee agenda also included later referral packages (Resolutions 26-129 and 26-130) aimed at additional apartment-district properties, including some evaluated in a sea-level-rise exposure context. Those items are a separate wave from 26-111. This article does not treat committee agenda placement as a completed rezoning of Papakea.

Bill 9 vs Bill 88 at Papakea

Bill 9 is the apartment-district TVR phase-out. For West Maui, the statutory planning date is January 1, 2029 unless an exemption or other lawful permission applies. Bill 88 created H-3 and H-4 as districts in the code. Papakea’s appearance in a 26-111 referral is a possible land-use pathway, not a completed escape hatch. Rental Use: What Buyers Need to Verify

Do not treat a Papakea listing’s rental remarks as a legal opinion. Verify county rules and current zoning, AOAO governing documents, any rental-management restrictions, licensing or registration where applicable, and the fact that legislation can still move. Past rental history is evidence of what occurred, not a warranty of what will be allowed.

Beyond Rental Rules: Papakea Buyer Due Diligence

  • HOA dues: what they cover and how they have moved
  • Reserves and any planned or discussed capital projects
  • Master insurance and what an owner still insures
  • Special assessments, past or pending
  • Shoreline and coastal exposure for the stack you are buying
  • Financing: whether a typical lender will treat the project as warrantable, specialized, or cash-preferred
  • Unit condition versus building-wide systems
  • Fee-simple versus any leasehold exception on the specific unit (confirm on title)

How Papakea Compares With Similar West Maui Condos

Buyers often cross-shop Honokowai and Kahana low-rises on price, then Kaanapali product on amenity and zoning clarity. Keep the comparison short and building-specific.
